Introduction

At ESSIEM, LLC., we originally built the ESSIEM SYSTEMS platform from the ground up for our own trading needs, with love and determination, to create the most reliable and easy-to-use trading infrastructure possible.

Having realized its potential, we now offer this system to the community in good faith. While we welcome and encourage constructive use, testing, and feedback, we have zero tolerance for abuse, fraud, or attempts to exploit our services. These policies are designed to protect the integrity of our platform, our partners, and all users, ensuring fair and safe use for everyone.

By using ESSIEM SYSTEMS services, you agree to respect these principles and follow our Terms & Conditions below.

1. Service Overview

ESSIEM SYSTEMS, a product of ESSIEM, LLC, provides specialized trading server infrastructure, including VPS hosting, LXC containers, and custom solutions for algorithmic trading. Our services are designed for legitimate trading activities using platforms such as MetaTrader 4, MetaTrader 5, JForex, and other trading software.

2. Acceptable Use

Users must comply with the following:

• Services must be used for legitimate trading activities only.
• Users must not engage in illegal activities, fraud, market manipulation, or any actions that could overload or harm broker services. High-frequency trading (HFT) and legitimate automated trading are allowed provided the broker you are using allows this.
• No unauthorized access to other systems.
• No DDoS attacks or network abuse.
• No cryptocurrency mining or resource abuse.
• Users must comply with all applicable laws and regulations.

3. Account Responsibility

• Users are responsible for maintaining account security.
• Keep login credentials confidential.
• Report unauthorized access immediately.
• Use strong passwords and enable two-factor authentication when available.

4. Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. Scheduled maintenance will be announced when possible.

• *ESSIEM SYSTEMS is not liable for any trading losses due to service interruptions.

5. Billing and Payments

• Payment Timing: Services are billed according to the schedule selected at the time of purchase (monthly, quarterly, annually, or any other period established during service payment). Payment is required prior to service activation and renewal.
• Auto-renewal: Services automatically renew at the end of each billing period. Auto-renewal can be disabled at any time through the Client Portal.
• Refunds: Refunds for unused services are provided at our discretion on a case-by-case basis. Please contact support for requests.
• Chargebacks: Chargebacks will result in a 48-hour grace period for resolution. If unresolved, all services will be terminated immediately.
• Price Changes: ESSIEM SYSTEMS reserves the right to change prices with prior notice; new prices apply from the next billing cycle.
• Late Payments: Services may be suspended 2 days after the due date and terminated 3 days after if payment is not received.

6. Trading Disclaimer

ESSIEM SYSTEMS provides infrastructure. We are not:

• Responsible for your trading decisions
• Liable for trading losses
• A financial advisor
• A trading advisor

Trading involves risk. Past performance does not guarantee future results.

7. Termination

We reserve the right to terminate services for:

• Violation of these terms
• Non-payment
• Illegal activities
• Abuse of resources
• Security threats

8. Limitation of Liability

Our maximum liability is limited to the amount paid for services in the last 30 days. We are not liable for indirect, special, or consequential damages, including trading losses.

9. Changes to Terms

We may update these terms at any time. Continued use of services constitutes acceptance of updated terms. Significant changes will be communicated via email.

10. Governing Law

These terms are governed by the laws of New Mexico, USA. Disputes will be resolved in New Mexico courts.

12. Free VPS, Abuse, and Inactivity

• Free VPS services provided through partner brokers are monitored daily for compliance.
• Using a free VPS without a verified broker account is strictly prohibited. Users may be contacted and warned; however, ESSIEM SYSTEMS reserves the right to terminate, block, or permanently ban accounts immediately for fraudulent activities or misuse.
• Even if you initially qualified with a verified broker account, it is not legitimate to use another account or a different broker to continue accessing free services. Free VPS is tied to your verified broker account only.
• Users who stop trading, lose funds, or decide to switch brokers must not attempt to continue using free VPS with a new or different broker account. This will be monitored. Legitimate transitions require either creating a new broker account via our affiliate link or contacting support for guidance.
• Free VPS services with inactivity exceeding one month may be terminated. Users will usually be contacted before termination, but we reserve the right to act without prior notice.
• Users creating multiple accounts to exploit free trials, seasonal offers, or test servers will be permanently banned. This applies even if the user holds other paid services. No discussion or appeal will be considered.

13. Affiliate Conduct and Fraud

• Affiliates must act in good faith and comply with all legal and ethical standards.
• Affiliates are allowed to use ESSIEM SYSTEMS logos, provided media kits, or create their own promotional materials in their own languages. It is recommended to contact support or your assigned agent to ensure all materials comply with our guidelines.
• We are committed to helping affiliates and users; not all activity is prohibited. Constructive promotion and sharing of information is encouraged. However, affiliates may not engage in abusive, fraudulent, or misleading behavior, or use tactics that could harm ESSIEM SYSTEMS' interests or goodwill, or its users, site visitors, or prospective future users.
• Fraudulent or abusive affiliate behavior will result in permanent account termination and forfeiture of all remaining commissions without appeal. ESSIEM SYSTEMS actively monitors affiliates and reserves the right to take immediate action if misconduct is detected.
• It is strictly forbidden for affiliates to make negative statements, disparage, or defame:

Objective comparisons of services and pricing, as well as mentioning other services or brokers, are allowed provided that no defamatory or disparaging statements are made. It is recommended to consult with support before publishing, promoting, or sharing any materials that could raise questions about their appropriateness.

This prohibition applies across all media, including social media, printed materials, verbal communications, digital messaging, or any other communication channels.

14. Illegal Activities and Fraud

• ESSIEM SYSTEMS strictly prohibits and condemns illegal activities, fraud, system exploitation, and any attempts to gain unauthorized access, perform hacking, or conduct penetration testing on its infrastructure, or to use our platform to access, disrupt, or compromise third-party systems or individuals.
• Free trial services are provided to allow users to experience our systems, provide feedback, and evaluate functionality before purchasing.
• Any attempt to exploit, bypass, or manipulate our services for personal gain may result in immediate account termination, permanent bans, and legal action under the laws of the State of New Mexico.
• Our platform is built in good faith with the goal of providing traders with the most reliable, accessible, and user-friendly infrastructure.

15. Miscellaneous

• Services are provided "as-is," and ESSIEM, LLC., and ESSIEM SYSTEMS make no additional guarantees outside these terms.
• ESSIEM, LLC., and ESSIEM SYSTEMS reserve the right to modify, suspend, or discontinue services at any time.
• Any disputes regarding interpretation of these terms will be handled in good faith according to New Mexico law.

• Even though we provide these Terms & Conditions in multiple languages for your convenience, only the English version is legally binding. We strive for accuracy in translations but cannot guarantee exact equivalence.
